Treatment Check (“we”, “us”, “our”) is an independent dental second-opinion service operating in New Zealand at treatmentcheck.online. We review dental records, treatment plans and quotes supplied by patients and return an independent written opinion. We do not carry out dental treatment.

We are the “agency” responsible for the personal and health information described in this policy under the Privacy Act 2020 and the Health Information Privacy Code 2020 (the “HIP Code”).

2. Scope of this policy

This policy covers information we collect through our website enquiry form, by email, through any secure link we send you to submit your X-rays or scans, and during any video consultation. By using our service you agree to your information being handled as set out here.

We ask you not to send X-rays or clinical files through the website form. To protect your privacy, records are only requested after your enquiry, via a secure link with clear instructions.

4. How we collect it

We collect information directly from you — through the enquiry form, by email, through the secure upload link we provide, or during a video consultation. We collect it directly from you wherever practicable, as required by the HIP Code. If we ever needed to request records from another provider on your behalf, we would only do so with your explicit consent.

6. Health information & the HIP Code

Your dental records are “health information” and receive additional protection under the Health Information Privacy Code 2020. We handle them in line with the Code’s health-information privacy rules: we collect only what we need for your opinion, keep it accurate and secure, use and disclose it only for the purpose you gave it to us, and give you the right to see and correct it.

7. When we share information

Your review is confidential. We will only share your information:

8. Storage & security

We take reasonable steps to protect your information from loss, misuse and unauthorised access, use or disclosure. These include encrypted transfer of records, access controls so only those who need to see your information can, and reputable service providers who apply their own security safeguards. No online service can guarantee absolute security, but we treat your records with the care their sensitivity demands.

9. How long we keep it

We keep your information only as long as needed for the purpose it was collected and to meet our legal and professional record-keeping obligations. Health information relating to a review is retained in line with the standard applying to health providers in New Zealand (generally a minimum of ten years). When information is no longer required, we securely delete or destroy it. You may ask us to delete records we are not legally required to keep — see your rights.

10. Overseas & third-party providers

Some of the services we rely on (such as hosting, email and payment processing) may store data on servers outside New Zealand. Where information is held or processed overseas, we take reasonable steps to ensure it has comparable privacy protection to that required under New Zealand law. Our key providers include Google (Workspace email and enquiry records) and Stripe (payment processing).

11. Your rights: access & correction

Under the Privacy Act 2020 and the HIP Code you have the right to:

12. Cookies & website analytics

Our website may use basic cookies and analytics to understand how visitors use the site and to improve it. This information is aggregated and does not identify you personally. You can set your browser to refuse cookies, though some parts of the site may not work as well.

13. Privacy breaches

If a privacy breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Privacy Commissioner as required by the Privacy Act 2020, and take steps to contain and remedy the breach.

14. Changes to this policy

We may update this policy from time to time. The current version, with its “last updated” date, always applies and is published on this page.
